The claim arose when the client proceeded to trial on the advice of prior counsel who had advised the underlying action was likely defensible and that the client’s worst case downside exposure was under $20 million. But prior counsel failed to explore early settlement opportunities when the underlying action could have been settled for $10 million or less. The case proceeded to trial, and the jury ultimately returned a substantial adverse verdict. In compliance with the terms of the settlement, the parties’ identities and further details remain confidential.
